Pizza Hut – High Court Decision “Sets The Stage”

A landmark decision was made on 18 May 2018 by the High Court of Australia where concession of “good faith” was made a key issue. Alan Myers, QC and Tim Castle appeared for the applicant; Pizza Hut franchisee Virk Pty Ltd (in liquidation) applied for leave to appeal to High Court against a decision made by the lower courts.
Unfortunately, leave to appeal was refused which was disappointing news for the franchisee and liquidator Bob Jacobs. It is tough for franchisees to take on franchisors. Full details in the High Court transcript are available.
